Ryan Magers, 19, of Madison County, filed a lawsuit Tuesday against the Alabama Women's Center for Reproductive Alternatives in Huntsville, Alabama on behalf of the unborn child he's calling "Baby Roe" in addition to himself. The pregnancy was reportedly terminated six weeks after Magers' girlfriend learned she was pregnant.
The mother made an appointment for an abortion with the Alabama Women's Center, which guided her through a chemical abortion. The US Supreme Court has always been clear that fetuses are not people and greater importance is placed on a woman's rights over her partner's because she is the one who carries and delivers the baby, Dov Fox, a University of San Diego law professor, told the Washington Post.
'The only thing that [Ryan Magers] has is the right to sue, and so that is what Ryan is doing, suing on behalf of Baby Roe's estate, ' Helms said.
"It represents the real-life consequences of anti-choice "personhood" policies", she said, "which, by design, seek to demote the fundamental rights of women, and are a stepping stone in the anti-choice movement's ultimate goal of criminalizing abortion and punishing women".
Judger Barger was asked by WHNT if he knew that he was granting an aborted fetus legal rights, but he declined to comment.
According to Helms, Magers just "wants rights for fathers and unborn babies".
Many experts anticipate that the "Baby Roe" case will eventually find its way up to the Supreme Court.

"Under Alabama law, an unborn child is a legal person, ' the complaint reads".
The Alabama Women's Center for Reproductive Alternatives, unnamed people affiliated with the women's center, and an unnamed pharmaceutical company are included as defendants in the wrongful death suit. "I'm here for the men who actually want to have their baby".

"This is chilling-and completely unacceptable", wrote NARAL Pro-Choice America on Twitter.
"But again, Roe, and its modern revision Casey, necessarily imply that these are not children, and therefore that laws concerning paternal rights do not apply to abortion cases". Kavanaugh is a conservative justice who may become the fifth vote to overturn Roe v. Wade, the Supreme Court decision which struck down state law restricting abortions.
Self-described feminist Mona Eltahawy tweeted, "This is the U.S. in the year 2019: a man AND a fetus are suing an abortion clinic".
